I for myself, and on behalf of my company (where applicable) as
owner/officer or guarantor of the company, hereby certify, agree and
accept the following:
Delancey Car Service, Inc may investigate exchange and use information
and reports on the account(s), applicant(s), authorizing officers and
myself with credit reporting agencies and others from time to time and
without notice(s) to the applicant(s).
A 20% chauffeur's gratuity will automatically be added to all rides.
Applicant(s) acknowledege that Delancey Car Service may after, complete
or execute Delancey Car Service vouchers on Applicant(s)
behalf and accept the assessment of service charges in cases of no
show at Delancey Car Service discretion.
APPLICANT(S) ARE HEREBY NOTIFIED THAT THE CARS IN WHICH APPLICANT(S)
AND/OR THEIR ASSIGNEES WILL BE RIDING ARE INDEPENDENTLY OWNED AND
OPERATED VEHICLES. DELANCEY CAR SERVICE ACCEPTS NO LIABILITY WHATSOEVER
CONNECTED IN ANY WAY WITH THE OPERATION OF SAID VEHICLES AND/OR DRIVERS.
APPLICANT(S) HEREBY AGREE TO HOLD DELANCEY CAR SERVICE AND ITS EMPLOYEES
SAFE AND HARMLESS FORM ANY CLAIMS AND/OR DAMAGES WHATSOEVER OF ANY KIND
, SORT, NATURE OR ORIGIN. WHETHER PUNITIVE OR NOT INCLUDING BUT NOT
LIMITED TO LEGAL COSTS AND FEES.
Discounts ranging from 1% to 18% will only be applied free of any past
due balances and according to the then current Delancey Car
Service discount schedule.
Invoices are due fifteen days after issuance of bill. Accounts wholly or
partially unpaid 10 days after the due date are subject to serviceable
charge ranging from $5.oo to $20.oo dollars depending on the open
balance, in addition to the assessment of 1.5% monthly finance
charge. Inordinate delay in payment will further result in suspension
and/or cancellation of charge privileges at Delancey Car Service.
To induce Delancey Car Service to establish the account,
the applicant (s) personally, individually or jointly
unconditionally guarantee payment and performance of any and all
obligations under this agreement, The guaranty shall be continuing and
in evocable. Applicant (s) presentment, demand, notice of default and
non-payment or protest thereof and consent to any modification
and/or renewal of credit hereby granted and guaranteed,
In the event that any or all charges are not paid
within 45 days of invoicing, applicant (s) acknowledge the account as
delinquent and agree to all costs of collection, including but not
limited to attorney's fees of 1/3 of the sums of due or
$250.oo whichever is greater upon such delinquency.
Applicant (s) give Delancey Car Service permission
to submit unsigned credit cards vouchers stating that the
applicant's signature is on file or to amend, alter complete or execute
on behalf of the applicant (s), credit card voucher (s) in applicant's
name for payment of any charges.
WE HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY ALL THE
ABOVE TERMS AND CONDITIONS. SHOULD IT BECOME NECESSARY FOR ANY USAGE TO
BE CHARGED TO ANY CREDIT CARD, MY/OUR SIGNATURE SHALL BE CONSIDERED TO
HAVE BEEN MADE ON APPLICABLE CREDIT CARD VOUCHER AND I/WE GIVE DELANCEY
CAR SERVICE PERMISSION TO FILL OUT AND SIGN THE VOUCHER ON MY/OUR
BEHALF.
